General Terms and Conditions

These general terms and conditions are given to each Client who is purchasing services/products from Château des Vigiers Golf & Country Club (hereinafter called ‘CdV’) to enable the Client to place an order.   Thus, once the order is accepted by CdV, the Client agrees unreservedly to accept the following terms and conditions.

Should the Client place an order which is accepted by CdV but without signing the following conditions, the Client is deemed to have accepted the conditions outlined below.

Any change to the original order must be agreed between the two parties and accepted by CdV and confirmed in writing.   Any condition imposed by the Client at any time, but without the express agreement of CdV, will be null and void.

If on any occasion the enforcement of a particular condition would not be in the best interests of both the Client and CdV, the waiver of such condition by CdV does not preclude CdV from requiring full observance of all its conditions in the future.

The confirmation of a reservation by the Client implies his unreserved acceptance of the present terms and conditions.

I .  GUARANTEE OF RESERVATION

1.1  Hotel
Reservations are only valid once CdV has received the Client’s written confirmation (by letter, fax to 00.33. 5.53.61.50.20 or e-mail at reserve@vigiers.com) together with payment as follows :
Individuals  :  deposit ** of 30 % of the total cost of accommodation
or
Group : deposit** of 50 % of the total services which have been reserved. The prices shown on the quotation prepared by the hotel are guaranteed until the end of the option period.

NB – The names and exact number of participants must be provided to CdV 8 (EIGHT) days before the event.

1.2  Restaurant
30% on account* will be requested for banquets of 20 people or more.   For weddings, 50% is payable on account*

NB – The date, time and number of meals to be served must be confirmed at the latest 3 (THREE) working days before the event.  For all reservations of more than 60 covers, the final number of people must be confirmed 8 (EIGHT) working days before the event.

Confirmation of the reservation should provide the following information:   name, first name and address of the person making the booking, date of the booking, services reserved (number of people, length of stay …) and credit/debit card details of the person making the booking.   CdV will be unable to make the booking if the above information is not provided.  Unless the payment on account* or the deposit** is paid, the reservation CANNOT be guaranteed by CdV.

II .  RESTAURANT OPENING HOURS

2.1  Restaurant ‘Les Fresques’
19.00 to 23.30 – last orders 21.30

2.2  Brasserie ‘Le Chai’
Open from 12.00-23.30
Food orders from 12.00 to 14.30 and 19.00 to 21.30

2.3  ‘Fresques’ Bar
The Fresques Bar is open from 18.00 to 24.00.

2.4  Supplements
For private functions, after midnight, the supplement payable is as follows:
Up to 50 people: 250 € per hour
From 51 to 100 people: 350 € per hour
Over 100 people: 425 € per hour

For group bookings at least one meal per day must be taken at CdV.

III .  CANCELLATION

Cancellations, whether total or partial, must be notified in writing to CdV.

3.1  Hotel

Individuals
 :
More than 30 days before arrival date: Total deposit refunded
Between 15 and 30 days before arrival: Deposit refunded LESS 100€ administrative
charge
Less than 15 days before arrival: No refund of deposit

Groups :
Between 15 and 30 days before arrival : 50% of the cost of the services reserved and cancelled will be invoiced. 
Between 8 and 15 days before arrival: 75% of the cost of the services reserved and cancelled will be invoiced.
Between date of arrival and 8 days before : No refund of deposit.   Furthermore, the hotel will invoice the whole amount of the services reserved and cancelled, even if it is only a partial cancellation.

3.2  Restaurants and banquets
All cancellations will be invoiced in full.

IV .  EXTRAS

All extras (telephone, bar, minibar, boutique...) must be paid by each participant before departure. If any participant fails to settle the cost of extras, the Client will be invoiced and will be entirely responsible for payment.

V .  INSURANCE

The Client, or the Organiser, as representative of the Client, is responsible for any damage, direct or indirect caused by any of the participants at the event or anyone connected with it.

CdV accepts no responsibility for loss or damage from whatever cause (theft, etc.) affecting goods of any kind (personal effects, equipment…) brought to CdV by the Client or belonging to the participants, wherever they may be (car park, public rooms, etc…)

The Client/hirer undertakes to leave the areas used by his group in the state in which they were found.   It is recommended that the Client/hirer take out insurance, at his cost, to cover any possible damage to equipment left by him on the premises.  If any valuable items are involved, he should arrange security/surveillance, at his cost.

V .  MISCELLANEOUS

Access to CdV’s outdoor swimming pool is forbidden to non-residents.

CdV accepts no responsibility for events outside its control or force majeure (strikes, fire, water damage, etc.).

VI .  METHODS OF PAYMENT

Invoices amounting to less than 1.500 € must be paid in full before departure of the participants. Where the invoice is on account, bank details must be provided and payment is required on receipt of the invoice.

VII .  ENTERTAINMENT

Prior to any meeting or entertainment of a musical nature, SACEM must be informed and written approval must be obtained from CdV if it is not organising the event.

VIII .  COMPLAINTS

Any dispute or complaint raised after departure of the participants must be notified to the General Management of CdV by registered letter with proof of receipt within a maximum of 7 days.  

IX .  DISPUTES

Any dispute which cannot be settled amicably will be judged by the court at Bergerac.

Definitions

On Account – Partial payment to be deducted from the total of a present or future debt.   In the case of a sale the payment on account constitutes a binding commitment and the Client cannot cancel his order unilaterally.   He must take delivery of the item which he has purchased and pay the balance.
 
** Deposit – Sum of money paid by the Client to CdV to guarantee his commitment to a contract.   If the Client later decides not to go ahead, he can do so by forfeiting the deposit.   If CdV defaults, they are required to reimburse the deposit and to pay compensation.
